Guarantee: The Seller guarantees the dog against fatal viruses for 48 hours. It is the BUYERS responsibility to take the puppy to a licensed veterinarian within 48 hours of receiving the puppy and proof of the vet visit must be emailed to the breeder, if the puppy is not checked by a licensed veterinarian within 48 hours the guarantee of the puppy is terminated. The buyer agrees to assume any financial responsibility for this examination, veterinary expenses and/or medications are not covered in this contract. No guarantees of any type are offered other than the ones stated on this contract. No money will be refunded in full or in part, all payments received are non-refundable. The puppy is guaranteed to be in good health and checked by our certified veterinarian. The puppy is up to date on all shots and deworming. You also agree to not letting the puppy go outside in grass until they have received their 3rd set of vaccines. This guarantee does not cover what we in the Bulldog breeds consider normal: Cherry eye, kennel cough, Giardia, Coccidia, worms, CDDY/IVDD, Brucellosis or any type of internal or external parasite as these can be picked up after leaving the breeder, pneumonia, allergies, demuxed, mange, parvo-virus, heart murmur grades 1, 2 & 3, patella lunation grades 1, 2 & 3, knee patella, umbilical hernia, entropion or ecttropian, stenotic nares, inverted tails, cancer, tumors, growths, scabies, mite related illness, any other autoimmune disorders viral or bacterial infections, hypoglycemia, thyroid dysfunction and partial or total cryptorchidism. It also does not cover anything as a result of accident or injury. The above health issues are all fixable, or the dog is able to live a long healthy life. They are also things that are common in all bulldog breeds. The parents are healthy and have been through screening for all of the above. Environmental factors will not be covered by this guarantee, including allergies, dysfunction, demodectic mange and other autoimmune disorders. The seller does not assume responsibility for any reaction to any vaccination. The seller does not assume responsibility for any medical expenses incurred associated with any health problem. This guarantee does not apply to any physical problems which could be the result of an injury. If the dog develops a severe genetic health disorder prior to twelve months of age that directly result in death or mandatory euthanasia of the dog as documented by veterinary records supplied by the buyer to the seller, the seller agrees to replace the dog. This health Guarantee covers only DEBILITATING GENETIC DISORDERS. If the vet finds the puppy to have a GENETIC DISORDER which is sufficiently serious in the opinion of 2 independent vets to warrant euthanization of said pet the seller must be IMMEDIATELY NOTIFIED BEFORE THE PET IS PUT DOWN. In the event this occurs the seller agrees to replace the dog with another of equal value/ dna from same litter or future litter.ET ● Buyer must have proof of 2 different veterinarians that the puppy will need to be euthanized due to a genetic disorder in order to get a replacement puppy. ● A “necropsy” must be performed on the puppy by a licensed veterinarian and the report must be forwarded to the Seller within 72 hours of necropsy for review. Seller is not responsible for any vet fees (veterinarian exam, medications, x-rays, surgery, blood work) it is the sole responsibility of the buyer. Seller assumes no responsibility for any cost. ● If pet dies and there no necropsy preformed or no proof of debilitating genetic disorder is given to seller by 2 independent vets, then seller has the right to refuse this warranty and refuse the buyer of a replacement puppy. ● Provided seller’s veterinarian concurs from the necropsy report that the cause of death was due to a genetic condition, Seller agrees to replace puppy with another of same value. ● Seller is not guaranteeing the size, structure or weight of the puppy being purchased and neither replacement nor refund will be provided if buyer is unhappy with the puppy. ● Seller believes puppy is healthy, but seller is not guaranteeing the breedability, or fertile of any puppy. The Seller will provide a replacement dog as soon as availability permits. A replacement dog would be of equal value pick and sex or the replaced dog from an available breeding, no refundable money will be allowed. We will supply the dog free of charge; the shipping charges will be yours. Before a replacement is shipped we need proof of the dog being destroyed, or spayed or neutered, or we will reserve the right to ask for the dog to be returned to our kennel, if shipment is necessary, it will be under the buyer's responsibility. Note: Pre-departure vet check will insure both testicles have Buyer’ Responsibility: The buyer agrees to purchase the dog with no other guarantees expressed or implied including, but not limited to faults listed in FCI or AKC standard and other congenital or acquired defects. The buyer agrees to hereby waive and release the seller from any liability of any nature, for any injury or damage or loss the dog may suffer or cause, directly or indirectly, to any property or person, including specifically, but without limitation, any injury or damage resulting from the action of the dog. The buyer and Seller contains the entire agreement of both parties and shall be constructed and enforced in accordance with the law of the State of Florida, both parties specifically agree that there are no other agreements other than those set forth in this document, any legal action filed by either party in effort to enforce this contract will be filed in Hillsborough County Courthouse , each party acknowledges that they have read and understand the terms and conditions agreement and have voluntarily entered into and executed this agreement. AKC Pedigree papers will be provided once proof of spay or neutered has been given to Breeder (Pictures & proof from licensed Veterinarian) unless buyer paid for full breeding rights. Puppy care The buyer agrees to provide the puppy with routine preventative care and follow a veterinarian guideline for vaccination and deworming. The buyer agrees to keep the puppy away from dog parks, grassy areas, pet stores, etc. until the puppy is at least 16 weeks of age and has received final vaccination. The buyer agrees to keep the puppy away from lakes, rivers, oceans and other water with the puppy where the puppy could be in danger of drowning unless proper safety protocol is followed. The buyer agrees to provide adequate daily fresh water, high quality dog food (other foods can void health guarantee). The buyer assumes responsibility for protecting the puppy from loss, theft, danger, neglect and abuse. New owner understands this puppy is being sold to the person in this contract. If owner can no longer keep this puppy/dog it cannot be sold, transferred, or given away. The said puppy must be returned to 813 Frenchie’s LLC Nichole Sanabria at owners’ expense via flight nanny. No cargo shipping. Breeding Rights: If you have purchased breeding rights you are committing to health testing your dog and the potential stud prior to breeding. You commit to not breed said female no more than 3 times as long as she’s fit to breed each time. You commit if you sell your puppies with breeding rights that the potential buyer would be committed to these same standards. You also commit to not undersell the puppies for less than $5k unless the puppy is cleft and you're finding a good home for said puppy. You are not to breed a female under 18 months old unless second heat starts at 16 months, and she would have the litter by 18 months old. We do not guarantee the said female or male can get pregnant or be fertile. Once dog is retired, she/he cannot be given away. Must remain in your home as your family pet. You may only give away to me or an approved home by me, shipped at your expense via flight nanny or we can come to an agreeable option. NOTE: Deposits on Dogs are NOT REFUNDABLE. When the deposit is received, we then assign a dog to your name and order. Once deposit is received, that dog is not offered to another buyer. Dispute. (1) This is the entire purchase contract; no other promise or stipulations are included or implied in this sale. (2) In any and all legal action pertaining to this dog, this contract shall be considered to be legally binding. (3) In the event of any dispute or disagreement under this contract, the laws of Florida will govern the resolution of the dispute and venue for resolution of any dispute will be in Florida. (4) To the extent that any provision of this contract may be invalid under any law of the state of the buyer, all remaining provisions remain binding. In no way will 813 Frenchie’s LLC be held liable for anything in this contract or to the puppy’s health. By signing this agreement, we affirm that we have read, understand, and agree to abide to the terms and conditions.
